Legal rules for Written & Verbal Warning
- Corrective discipline normally suits minor misconduct where the standard is reasonable and known.
- Record the incident objectively and consider the employee response before finalising the certificate.
- The generator defaults to 3 months for verbal and 6 months for written warnings; these are workplace-policy defaults, not statutory minimums.
- Set a practical corrective standard and review expectations. Do not use a misconduct warning to bypass a genuine incapacity process.
Frequently asked questions
Is a verbal warning recorded in writing?
A written record can document the verbal warning, the discussion, required improvement and delivery without changing the warning level.
How long is a written warning valid?
This service uses 6 months for written warnings and 3 months for verbal warnings. Review your disciplinary policy and agreements.
Can I issue a warning without hearing the employee?
The employee must have a genuine opportunity to respond. Record the response or the actual opportunity given before finalisation.
What if the employee refuses to sign?
Record actual delivery and any refusal accurately. Use a witness where appropriate; refusal is not an admission and does not by itself invalidate a fairly issued warning.

Reviewed 18 October 2026. The September 2025 Code replaced the former Schedule 8 dismissal code. Sanctions are contextual, not an automatic three-strike ladder. Under LRA section 192, once dismissal is established the employer must prove fairness.
