Legal rules for Final Written Warning
- A final warning is not an automatic dismissal instruction. Assess seriousness, consistency, relevant active warnings and mitigation.
- Give the employee a genuine opportunity to respond before deciding the warning. Record the explanation and management finding.
- This service uses a 12-month final-warning validity period; check the applicable disciplinary code and collective agreement.
- An earlier allegation-notice signature is not receipt of the final warning. Obtain a separate acknowledgement after finalisation.
Frequently asked questions
Can a final warning be issued for a first offence?
A sufficiently serious proven breach may warrant it, but the facts, consistent treatment and a fair opportunity to respond determine the appropriate outcome.
Does a final warning expire after 12 months?
This generator uses 12 months. This is a product default, not a universal statutory period; check your workplace code and agreements.
Must the employee agree with the warning?
No. Acknowledging receipt does not mean admitting guilt or agreeing with the decision.
Can I dismiss automatically after a final warning?
No. Investigate any later alleged breach, consider whether the warning is relevant and active, hear the employee and assess a fair sanction.
